2. The petitioner has prayed for bail in connection with Goraul P.S. Case No. 277 of 2023 registered for the offence punishable under Section 394 of the Indian Penal Code.
3. The case of the prosecution is that on 25.06.2023, the informant was returning after attending a wedding party along with his cousin Alok Kumar on his bike. As he left for his home in village Rohua, he found two men on a white coloured Apache bike following him and signaling to stop. The informant got scared as the road was deserted. He started running very fast with bike. One of them fired two bullets at the informant which hit his mobile phone which was in his pocket. After which, he kept moving then another fire was made which hit his leg and
Patna High Court CR. MISC. No.79473 of 2024(3) dt.29-01-2025 2/3 one of the bullet hit the right hand of his cousin. After this, he started driving the bike and started running towards Purvi lane and informed his family.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. itself it is clear that the F.I.R. was lodged against unknown miscreants. From perusal of the impugned order, it is clear that name of this petitioner has surfaced in the confessional statement of co-accused Anvarat Ravi @ Vikku Kumar. Nothing has been recovered from his possesion. His name has surfaced only on the confessinal statement of co-accused Anvarat Ravi @ Vikku Kumar. Learned trial Court has refused his prayer of bail only on the ground that he is having criminal antecedent of six cases. He is languishing in judicial custody since 07.11.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail
Patna High Court CR. MISC. No.79473 of 2024(3) dt.29-01-2025 3/3 bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Goraul P.S. Case No.277 of 2023.
