Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Tikapatti P.S. Case No. 58 of 2022 dated 02.07.2022 registered for the offences punishable under Sections 147, 149, 323, 365 and 302 of the Indian Penal Code.

The main submissions advanced by learned counsel for petitioner are that the petitioner is not named in the FIR, his name surfaced during investigation in the restatement of the informant, the main allegation is against co-accused Yogendra Mandal, with whom the informant's son (victim) was admittedly having some money dispute and specific allegations are against co-accused persons including Yogendra Mandal and the dead body of the victim was found from the house of the said coaccused Yogendra Mandal and the petitioner has no connection

Patna High Court CR. MISC. No.1316 of 2023(3) dt.04-05-2023 2/2 with the co-accused Yogendra Mandal, infact at the time of commission of the alleged occurrence a crowd had gathered and petitioner was simply a spectator and he had no enmity with the deceased so there is no reason for him to be involved in the alleged occurrence with the co-accused persons. 4.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the facts that the petitioner is not named in the FIR and the main allegation is against co-accused Yogendra Mandal, with whom the victim had some dispute and the dead body of the victim was found from the house of the said co-accused and as per the statement made in paragraph no. 10 of the petition, the petitioner has no connection with the said co-accused, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Tikapatti P.S.
