JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Connection with Tr. No. Mahkar P.S. Case No. 17 of 2019 arising out of Kateya P.S. Case No. 286 of 2019, registered for offences punishable under Sections 20, 22, 25, 29 of the NDPS Act.
Allegation is of recovery of 2 kg of ganja from the house of the petitioner and though he is accused in one more case but that is not similar as the present one. It has been submitted on behalf of the petitioner that charge-sheet has already been submitted and he has been in custody for last five months and ready to abide by any condition imposed on him.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.71465 of 2019(2) dt.13-01-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Gopalganj, in Connection with Tr. No. Mahkar P.S. Case No. 17 of 2019 arising out of Kateya P.S. Case No. 286 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
