Petitioners apprehend their arrest in Panapur P.S. Case No.107 of 2017 instituted for the offence under Section(s) 420, 406, 409, 120-B Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, IV, Saran at Chapra.
There is allegation against the petitioners that they purchased 2124 quintals paddy from the farmer on minimum support price by government, but supplied only 993.20 quintals of rice to the BSFC in place of 1423.08 quintals rice. During physical verification of the godown, 429.88 quintals rice was not found in the godown value of which is Rs.10,21,394.88.
Patna High Court Cr.Misc. No.2110 of 2018 (4) dt.27-02-2018 2/2 Case diary has been received, wherein, allegation against the petitioners is found to be correct during investigation. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioners for grant of anticipatory bail is rejected.
Petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
