02. In the present case, the petitioner seeks bail in connection with Forbesganj P.S. Case No. 283 of 2025 registered for the alleged offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) of Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, petitioner and other coaccused persons, making an unlawful assembly, came to the house of the informant and assaulted the brother of the informant with iron rod, spade and dabiya causing a number of injuries to him. When the informant, his another brother and his mother went to save him, they were also assaulted with iron

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No such occurrence as alleged in the FIR has ever taken place. There is delay of three days in filing the present case and the same has not been explained. Further, there is delay of 10 days in sending the FIR to the court. These facts create doubt over the manner of occurrence. On bare perusal of the FIR, it appears that there is no motive behind the occurrence. The informant in his further statement and the victim Deepak Mandal and other witnesses in in their statements, did not utter any word about the presence of the petitioner at the place of occurrence. There is case and counter case and the petitioner side has filed a Complaint Case No. 1138 of 2025 against the informant side.
Co-accused persons, namely Rohit Kumar Mandal and Pawan Kumar Mandal have been granted anticipatory bail by a Co-ordinate Bench vide order dated 24.09.2025 passed in Criminal Misc. No. 67687 of 2025 and the case of the petitioner stands on better footing. The petitioner has not even present at his village at the time of occurrence as he was in Delhi.
3/4 Bench vide order dated 16.09.2025 passed in Criminal Misc. No. 64337 of 2025. The petitioner is having clean antecedent. The petitioner is in custody since 03.08.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/court concerned in connection with Forbesganj P.S. Case No. 283 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates
4/4 or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
