2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The case of the prosecution is that on 18.07.2023 at about 11.45 P.M., the informant was going to his house at Muzaffarpur from Bhagwanpur by his bike bearing registration No. BR06AE 6014. Meanwhile on the way, two miscreants on a bike intercepted the informant's bike and on the gun point, forcibly snatched his laptop, mobile and Rs. 5,000/- in cash. The case was registered against unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

It is also submitted that the name of this petitioner has surfaced in the confessional statement of one Raushan Kumar and Anvarat Rai. Except confessional statement, there is nothing against the petitioner. It is next submitted that no recovery has been made from the possession of the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 07.11.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submits that petitioner is having criminal antecedent of seven cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gorual P.S. Case No. 313 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
