Mr.Mukeshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-01-2020 Heard learned counsel for the petitioners, learned counsel appearing for informant and the learned A.P.P. for the State.

The petitioners seek bail in connection with Bakhtiyarpur (Kanariya OP) P.S. Case No. 212 of 2019, registered under Sections 341, 323, 504, 379, 436, 364 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 01.06.2019 at about 9.30 P.M., informant Binod Yadav was plying boat at Kharra

Patna High Court CR. MISC. No.75362 of 2019(3) dt.07-01-2020 2/2 Ghat, at that time, 19 persons named in the F.I.R. including the petitioners reached there variously armed with weapons and set fire on two boat worth of Rs. Nine Lakhs and also took cash of Rs. 1,50,000/- and snatched gold chain and they also kidnapped his nephew Nitish Kumar.

Learned counsel for the petitioners submits that victim Nitish Kumar returned to his house and his statement was recorded under Section 164 of Cr.P.C. in which he stated that he was carried by the accused named in the F.I.R. and all assaulted to him and made query about sleeping place of his uncle Parmanand Yadav. Further submission is that petitioner Nos.1,2 and 3 are in custody since 02.06.2019 and petitioner No.4 is in custody since 11.07.2019.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Saharsa in connection with S.T. No. 170 of 2019, arising out of Bakhtiyarpur (Kanaria O.P) P.S. Case No. 212 of 2019.
