JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner, who is in custody since 05.09.2019, seeks bail in connection with Chandradip P.S. Case No. 84 of 2019, dated 25.07.2019, instituted for the offences under Sections 147, 148, 149 and 302 of the Indian Penal Code. The petitioner is not named in the FIR.

Two strands of narrative appear from the FIR as also from the investigation papers.

The mother of the deceased has alleged that because of stampede, the deceased had entered in the house of one Gyan Sao where he was killed by 15 to 20 persons. The other story is that the deceased had injured somebody

Patna High Court CR. MISC. No.72534 of 2019(3) dt.05-03-2020 2/2 and, in retaliation, he was caught by the members of public and assaulted to death. The name of the petitioner has transpired only during the supervision by a superior police officer.

It has been submitted on behalf of the petitioner that nothing specific has been alleged against him. The deceased is stated to be a person of criminal antecedents.

Regard being had to the entire set of facts and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Chandradip P.S. Case No. 84 of 2019.

The application stands allowed.
