The learned counsel for the petitioner seeks permission to withdraw the application for grant of anticipatory bail on behalf of petitioner No.1 with liberty to approach the Court below for regular bail. In the event of surrender by petitioner No.1 in the Court below, the Court below may consider and dispose of the application for regular bail on the same day without being prejudiced this withdrawal of this application. So far petitioner No.2 and 3 are concerned, they have no criminal antecedent and considering the fact that the others have

Patna High Court Cr.Misc. No.13770 of 2018 (2) dt.05-04-2018 2/2 granted anticipatory bail by coordinate Bench by this Court in Cr. Misc. No.4372 of 2018 vide order dated 01.02.2018, let the petitioner No.2 and 3, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P.S. Case No.233 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
