====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioners apprehend their arrest in connection with Sikandra Police Station Case No.59 of 2018 registered under Sections 120(B), 420, 421, 409, 467, 468, 471 and 477(A)/34 of the Indian Penal Code.

The accusation is that the complainant/informant

Patna High Court CR. MISC. No.76841 of 2019(2) dt.03-02-2020 2/3 Sunil Kumar Pandey was the teacher in Rajo Singh Raghunath High School, Manjosh, Sikandara. In the year 2012, grant of Rs.31,62,000/- was received in the school from the Bihar School Examination Committee, Patna, for distribution amongst the teachers. The petitioners being the Member of the Management Committee, Incharge Headmaster and Assistant Teacher respectively of the said school in collusion with the District Programme Officer, Jamui, got the signature of the informant in the Register but the payment was not made to him. Learned counsel for the petitioners submits that, in fact, the informant never visited the school, due to that reason, the payment was not made to him. The informant had also filed Case No.

16 of 2017 before the District Appellate Authority, Jamui, and after hearing, his claim was rejected on 16.12.2017, which would appear from Annexure-3 to this application. Thereafter, only to put undue pressure, the informant lodged the Complaint Case No.829 of 2016, on the basis of which the present case was lodged against the petitioners. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.

Patna High Court CR. MISC. No.76841 of 2019(2) dt.03-02-2020 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Shri M.K. Pandey, Judicial Magistrate, First Class, Jamui, in connection with Sikandra Police Station Case No.59 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
