JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Manigachhi P.S.Case No. 272 of 2014 registered for the offences under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and others.
Submission of learned counsel for the petitioners is that during investigation no case is made out under Section 307 IPC. However, cognizance has been taken under Section 307 IPC also and there is case and counter case between the parties. Heard learned APP also.
In the facts and circumstances, let the petitioners, above
Patna High Court Cr.Misc. No.4014 of 2018 (2) dt.01-02-2018 2/2 named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Manigachhi P.S. Case No. 272 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
