The petitioner is languishing in custody since 26.08.2019 in a case registered for the offence punishable under Section 414 of the IPC.

The prosecution case is that the petitioner was found driving a stolen motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner was driving the motorcycle bona fidely and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner was driving the stolen motorcycle.

No.69316 of 2019(2) dt.27-11-2019 2/2 Considering the nature of accusation, period under custody and the investigation already being concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Maheshkhunt P.S. Case No. 106 of 2019.
