2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 379 and 366(A) of the Indian Penal Code.

3. As per the prosecution case , these petitioners along with other co-accused persons

Patna High Court CR. MISC. No.80710 of 2023(3) dt.05-03-2024 2/3 kidnapped the minor daughter of the informant for the purpose of marriage .

4. It is submitted on behalf of the petitioners that petitioner No. 1 is the father , petitioner No. 2 is the mother and petitioner No. 3 is the sister of the coaccused Deepak Kumar and they are innocent and have falsely been implicated in this case. It is further submitted that during course of investigation victim has denied the prosecution case and she has categorically stated that she has solemnized marriage with co-accused Deepak Kumar. Petitioners claim clean antecedent.

5. Learned counsel for the State and informant vehemently oppose the bail petition.

6 Considering the statement of the victim and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the JM 1st Nalanda at Biharsharif in

Patna High Court CR. MISC. No.80710 of 2023(3) dt.05-03-2024 3/3 connection with Noorsarai P.S. Case No. 138 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
