2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 366 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that during investigation the victim has given her statement under Section 161 and 164 Cr.P.C. wherein she has stated that she has not been kidnapped by anybody. She has further stated that she has gone from her house on her own will. From there she

Patna High Court CR. MISC. No.79527 of 2024(3) dt.27-02-2025 2/2 went to Gujarat with the petitioner. She lived there for two months with the petitioner and she has solemnized marriage in a temple with the petitioner. It is the case of relationship out of marriage.

5. Learned APP appearing for the State as well as has opposed the prayer of regular bail of the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bakhri P.S. Case no. 216 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.

7. Accordingly, the present bail application stands allowed.
