The petitioner seeks bail in connection with Samastipur Muffasil P.S. Case No. 216 of 2023 instituted for the offence under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case, in short, is that on 04.04.2023, while two employees of Credit Access Gramin Ltd., Samastipur were carrying Rs. 5,60,470/- to deposit at SBI Kashipur, four unidentified miscreants on two motorcycles intercepted them near Bhaichara Chowk, snatched the cash bag at gunpoint, and fired in the air before fleeing.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.12.2024. Petitioner bears ten (10) criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused. Nothing has been recovered from the conscious possession of the petitioner. Petitioner was not even put on T.I. Parade to ascertain his complicity in the alleged occurrence. It is mainly submitted that at the time of occurrence, petitioner was languishing in custody in another case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and manner of petitioner's implication, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like
Patna High Court CR. MISC. No.80625 of 2025(3) dt.11-02-2026 3/3 amount each to the satisfaction of Court below/concerned Court in connection with Samastipur Muffasil P.S. Case No. 216 of 2023, subject to the following conditions:
(I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial and shall not remain absent on two consecutive dates without sufficient cause.
(III) The petitioner will not tamper with the evidence or the witnesses during the trial.
(IV) Petitioner shall not commit offence of similar nature in future.
(V) Petitioner shall not leave the territorial jurisdiction of the learned Court below without taking prior permission of the court concerned.
If any of the above conditions are violated, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
