JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Sultanganj P.S. Case No. 129 of 2019 for the offence under Sections 147, 148, 149, 448, 325, 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been acquitted in Sultanganj P.S. Case No. 170 of 2018 whereas he is on bail in other cases. It is alleged that the petitioner opened fire upon the informant on the order of coaccused Neelam Devi which caused injury to Pradeep Kumar Yadav. Learned counsel further submits that the petitioner has been named in the FIR because he is the husband of Ward

Patna High Court CR. MISC. No. 69779 of 2019(4) dt.03-06-2020 2/2 Member of Ward No.11 of Nagar Parishad Sultanganj whereas the informant is Chairman of Nagar Parishad. The petitioner is in custody since 28.06.2029.

Considering the fact that the petitioner has remained in custody for more than 11 months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st, Bhagalpur in connection with Sultanganj P.S. Case No. 129 of 2019, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of three months in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
