====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 149, 323, 307, 354, 448 and 427 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has antecedent of two cases and is in custody since 17.10.2022.
Allegation is of assaulting the son and wife of the informant by the accused persons including the petitioner for creating hurdle in the construction work of Rajesh Paswan (brother of the informant).
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is further submitted that the petitioner and the informant are
Patna High Court CR. MISC. No. 806 of 2023(2) dt.29-04-2023 2/2 relatives and on account of dispute relating to land filed cases against each other. It is next submitted that no injury was found on the person of the injured or else the same would have been recorded in the impugned order.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marachi P.S. Case No. 142 of 2022.
