JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-02-2018 Learned counsel for the petitioner, at the very outset, seeks permission and is allowed to make State Bank of India as opposite party No.2 and necessary correction in the body of the petition during course of the day.

Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Matihani Police Station Case No. 155 of 2017, disclosing offences under Sections 406, 420, 120(B), 504/34 and 506 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be

No.7922 of 2018 (3) dt.19-02-2018 Computer Operator in the Customer Care Centre, Badalpur and he was not responsible for maintaining any cash nor responsible for disbursement of any amount to the customer rather he has to work under the control of Co-ordinator of the said center, who has already been granted bail. Hence, the petitioner deserves the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Class, Begusarai, in connection with Matihani Police Station Case No. 155 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
