The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that no foreign liquor was recovered from the conscious possession of the petitioner rather it was recovered from the Centro car which was standing in front of the house of the petitioner. He further submits that the petitioner has got clean antecedent and is in custody since 26.09.2019.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail

Patna High Court CR. MISC. No.70642 of 2019(2) dt.25-11-2019 2/2 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Begusarai-cum-Special Judge, Bihar Prohibition and Excise Act, 2016, Begusarai in connection with Town P.S.Case No.427 of 2019, subject to condition that the petitioner will deposit Rs.5,000/- (five thousand) in the Nazarath, Civil Court, Begusarai, such deposit of Rs.5,000/- (five thousand) shall abide by the out-come of the present criminal case.
