JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 10-12-2024 In the instant writ petition, petitioner has prayed for the following relief (s) :- "For issuance of a writ in the nature of writ of Mandamus commanding the respondents for immediate payment of compensation to the petitioner against acquisition of his land area 63 decimals of land from Tauzi No.5443, Zamabandi No.278 of Khata No.292, Khesra No. 104,1101 out of one acre nineteen decimals (1.19 decimals) of land which was recorded in the name of his father Balmukund Singh, and further issuance of writ in the same nature directing the respondent No.3 for payment of that compensation amount be paid with interest."

Learned counsel for the petitioner submitted that petitioner's ancestral land appertaining to Tauzi No. 5443, Zamabandi NO. 278, Khata No. 292, Khesra No. 1573 area 63 decimals was acquired out of 1 acre 19 decimals of land for construction of Kazra Thermal Power Station in the year 2011. Learned counsel submits that although petitioner's land has been acquired but no compensation has been paid as yet. Petitioner has represented his grievance before the Collector, Lakhisarai on 11.11.2016, but no action has been taken till today.

3. Learned counsel for the State submitted that it is matter of record. However, in case petitioner files fresh representation before the concerned authority, the same shall be looked into.

Considering the facts and circumstances of the case and the arguments advanced on behalf of both the parties, the present writ petition is disposed of with liberty to the petitioner to approach the authority concerned by filing fresh representation for redressal of his grievance, which has been raised by the petitioner in the present writ petition, within a period of four weeks from the date of receipt of a copy of this order.
