Mr.Mohammad Sufyan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-04-2023 Petition for pre-arrest bail of petitioner no.3 is dismissed as withdrawn as he has already been arrested during pendency of the bail petition.

Heard learned counsel for the petitioners no. 1, 2, 4, 5 and 6 and the State.

Petitioners no. 1, 2, 4, 5 and 6 apprehend their arrest in a case registered for the offence punishable under Sections 353, 431, 497, 504/427 and other allied sections of the IPC and sections 3⁄4 of the Damage of Property Act.

Patna High Court CR. MISC. No.5974 of 2023(2) dt.13-04-2023 2/3 Petitioners and other accused persons named in the FIR and other unknown 200 people are alleged to have blocked the road and when police party reached there, the accused persons obstructed the police party in discharge of their official duty and they also pelted stones and damaged police vehicle. Learned counsel appearing for the petitioners no. 1, 2, 4, 5 and 6 submits that the petitioners are innocent and have falsely been implicated in this case due to village politics. No overt act has been alleged against them. Petitioners no. 1, 2, 4, 5 and 6 have got no criminal antecedent.

Considering the nature of allegation against petitioners no. 1, 2, 4, 5 and 6, in the event of arrest/surrender within six weeks from today, let the petitioners no 1,2,4,5 and 6 named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Khaira Police Station Case No. 469 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
