JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2024 Heard the learned senior counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner seeks regular bail in the present case registered for the offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is alleged to have killed the deceased after hatching conspiracy. A detailed planning was made to kill the deceased.

4. Learned senior counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his role has not been supported by the eye witnesses. Petitioner is in jail since 02.11.2022.

5. Learned counsel for the informant has submitted

Patna High Court CR. MISC. No.79523 of 2023(3) dt.05-07-2024 2/2 that the face of the petitioner has been captured in the CCTV footage as one of the assailant of the deceased.

Learned A.P.P. has also vehemently opposed the prayer for bail and has submitted that the crime was committed on the instruction of dreaded criminals Bhola Singh, Mukesh Singh and Raghunath Singh after payment of Rs. 1.5 Crores to the petitioner and other accused and the involvement of the petitioner cannot be denied in view of his recognition from the CCTV footage as one of the assailants of the deceased.

7. Co accused Shahansah Kumar and Raghunath Singh had moved this Court for grant of bail and there prayer for bail has been rejected by this Court.

8. Considering the fact that in this case the petitioner is one of the assailants of the deceased and has worked as a hired criminal after taking 1.5 Crore for killing the deceased, I am not inclined to grant bail to the petitioner.

9. Accordingly, this application for regular bail is hereby rejected. The court below is directed to expedite the trial of the petitioner.
