12-02-2018 Heard Sri Arun Kumar Jha, learned counsel for the petitioners and Sri Umeshnand Pandit, learned Addl. Public Prosecutor.

Six petitioners, apprehending their arrest in Jadia P.S. Case No. 110 of 2017 registered for offence under Sections 147, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender.

Learned counsel for petitioners, by way of referring to F.I.R., submits that only allegation of giving dabiya blow was against accused Dharmdeo Sutihar, who is not petitioner in the

Patna High Court Cr.Misc. No.6801 of 2018(2) dt.12-02-2018 2/2 present case. So far as petitioners are concerned, there is no specific accusation. He further submits that petitioners are next door neighbour of the informant and during investigation, save and except injury, which was caused by Dharmdeo Sutihar, no other injury was found on the person of the informant side. Considering the fact that there is specific accusation against Dharmdeo Sutihar, who is not before this Court and there is general and omnibus allegation, in the event of arrest or surrender within a period of six weeks from today, let aforesaid six petitioners namely 1. Binod Sharma, 2. Shambhu Sharma, 3. Sanjeev Mandal @ Sandeep Mandal, 4. Brahmdeo Sutihar @ Brahamdeo Sharma, 5. Gopal Sharma and 6. Sahdeo Sharma be enlarged on bail on furnishing bail-bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - V, Supaul in connection with Jadia P.S. Case No. 110 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
