This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 304(B) and 201/34 of the Indian Penal Code registered in connection with Nanpur P.S.Case No. 263 of 2022.

The marriage of the daughter of the informant was solemnized with co-accused Sonu Mishra. The matrimonial inmates tortured her for non-fulfilment of dowry demand of rupees one lakh cash and a motor-cycle. On 17.06.2022, the informant went to meet her daughter where the accused persons, named in the FIR, apprised him that his daughter is traceless. It also came to light that on 12.06.2022 the dead-body of his daughter was found at the brick-kiln of Vijay Chaudhary. The informant identified the dead-body of his daughter. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.217 of 2023(2) dt.27-03-2023 2/2 that the petitioner is innocent. He has falsely been implicated in this case merely because he is brother-in-law (nandosi) of the deceased having nothing to do with the day-to-day affair of the husband and wife. He is in custody since 18.08.2022. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Nanpur P.S.Case No. 263 of 2022, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
