2. Prayer is allowed.

3. If the petitioner surrenders and prays for regular bail before the court below within a period of three weeks, the same shall be considered on its own merits without being prejudiced by the present withdrawal and it may also be taken into consideration that the petitioner is only a driver of the truck owner having no criminal antecedent and some other accused persons have been granted regular bail.
