The petitioner apprehends his arrest in Paharpur P.S. Case No.144/2017 registered under Section 307 and other minor sections of the Indian Penal Code.
The informant alleged that the petitioner along with six other persons, having armed with different weapons entered into the house of the informant and assaulted him with farsha on his head. The accused persons also alleged to have taken away different articles from the house of the informant. Learned counsel for the petitioner submits that there is a case and counter case between the parties for which Paharpur P.S. Case No.145 of 2017 has been lodged. The petitioner Chokat Raut is said to have also assaulted the informant Hiraman Sah with
Patna High Court Cr.Misc. No.17921 of 2018 (2) dt.06-04-2018 2/2 farsha on his head but the injury report of Hiraman Sah shows that he got one lacerated wound near middle of skull and another lacerated wound on his right leg. Both the injuries are caused by hard and blunt object. No sharp cutting weapon was used, although the petitioner is alleged to have assaulted with farsha. Both the injuries are simple in nature.
Considering the aforesaid fact that there is a case and counter case between the parties and the informant got simple injuries, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihar, East Champaran, in connection with Paharpur P.S. Case No.144/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
