JUSTICE PURNENDU SINGH ORAL ORDER 05-03-2025 Heard Mr. Yugal Kishore, learned counsel appearing on behalf of the petitioner; Mr. Dr. Ajeet Kumar, learned APP for the State and Mr. Manish Kumar Singh along with Mr. Dharmendra Kr. Singh, learned counsel for the informant.

2. The petitioner seeks pre-arrest bail in connection with Town P.S. Case No. 434/2024 registered for the offence(s) punishable under Sections 108/109 /118 /352 /351 (3)/287/308(3)/62/3(5) of BNS.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioner have threatened the informant's husband and demanded Rs. 2 lakh to vacate his land and also threatened to file a case under SC/ST Act against the entire informant's family, as a result of which, her husband got depressed and set himself on fire in the D.M. office,

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. Petitioner has clean antecedent.

5. Learned counsel appearing on behalf of the informant has vehemently opposed the prayer for grant of prearrest bail and submitted that the deceased in his dying declaration has stated that the petitioner along with other coaccused have threatened and harassed him, as a result of which, he was forced to set himself on fire. He further submitted that pre-arrest bail applications of other co accused persons, carrying similar allegation, have also been rejected by this Court.

6. Learned APP for the State has also vehemently opposed the prayer for grant of pre-arrest bail.

7. Having considered the rival submissions made on behalf of the parties, as well as the nature of allegation made against the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the present bail application stands dismissed.
