JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-02-2018 Heard the learned counsel for the petitioners and learned counsel for the State.

The petitioners seek anticipatory bail in connection with Sahjanahpur PS case no. 18 of 2017 dated 5.4.2017 registered for the offences punishable under Sections 420/ 406/ 504/ 506/34 of the Indian Penal Code.

The case of the prosecution is that the petitioners herein had conspired together and tried to grab the land of the informant. The learned counsel for the petitioners submits that the land was purchased by the petitioner nos. 1 to 4 in the year 1982 and thereafter they have been coming into peaceful possession of

In any case it is submitted that the present case arisen out of purely a civil dispute and the remedy of the informant lies before the competent court of civil jurisdiction. The petitioners are having a clean antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City in connection with Sahjanahpur PS case no. 18 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
