JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 8/20(b)(ii)(c)/23(c), 29 of the N.D.P.S. Act.

Prosecution case is that 230 kg of ganja was recovered from the truck of the petitioner. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. He has clean antecedent. Learned counsel for the State submits that the huge amount of ganja was recovered from the vehicle. It is further alleged that petitioner is the registered owner of the vehicle in

Considering the facts of the case as also the fact that huge quantity of ganja has been recovered from the vehicle of which petitioner is registered owner, prayer for anticipatory bail is rejected.
