Madhuri Lata, learned Additional Public Prosecutor for the State and Mr. Sandeep Kumar Gautam, learned counsel for the informant. The petitioners seek pre-arrest bail in connection with Matihani P.S. Case No.181 of 2017 registered under Section 307 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.
Considering the direct and specific allegation made in the first information report that the petitioners opened fire causing injuries to the informant and the corresponding injuries were
Patna High Court Cr.Misc. No.22268 of 2018 (2) dt.27-04-2018 2/2 found by the doctor as noticed by the learned Sessions Judge, Begusarai in the order impugned dated 16.02.2018 wherein he has stated that paragraph-34 of the case diary shows injury nos. 1, 2, 3 and 5 grievous in nature caused by firearm, I am not inclined to grant them pre-arrest bail.
