JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Sheo Sagar P. S. Case No. 417 of 2018, disclosing offence under Section 392 of IPC. As per F.I.R. three miscreants have intercepted the complainant, taken away the tractor loaded with the rice and also snatched away the mobile phone.
Submission of the learned counsel for the petitioner is that he is not named in the F.I.R. Later on, on confessional statement of the co-accused, who is also named in the F.I.R., he has been made accused in this case. Except that there is nothing against him. He is accused in one more case also, but in that case also he has been made accused on the confessional statement. Further submission is that nothing has been recovered from the possession of the petitioner.
Patna High Court CR. MISC. No.71020 of 2019(3) dt.21-11-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that in such type of case T.I.P. is required and as such, custodial interrogation of the petitioner is also essential.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
