JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-02-2018 The petitioner seeks bail in anticipation of his arrest in connection with Chowk P.S. Case No. 282 of 2017 instituted for the offences under Section 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act, 1881. The petitioner is alleged to have issued three cheques of Rs. 2,50,000/- but none of those could be encashed. Learned counsel for the petitioner has submitted that petitioner had deposited those three cheques as security to the informant which has been misused.
Learned counsel for the informant, however submits that from the perusal of the F.I.R, it would appear to be a clear cut case of cheating.
Considering the facts and circumstances of the
Patna High Court Cr.Misc. No.4307 of 2018 (2) dt.01-02-2018 2/2 case, this Court is inclined to grant anticipatory bail to the petitioner.
The petitioner, above named is directed to be released on bail, in the event of his surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna City in connection with Chowk P.S. Case No. 282 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
