JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Laheri P.S. Case No. 118 of 2017 instituted for the offence under Sections 406,409,420,467,468 of the IPC.

It is alleged in the written report that the informant opened his bank account in Central Bank Staff Co-operative Ltd., in which one Nalin Bilochan, was the Director and this petitioner was the Branch Manager. They have misappropriated the collected amount. The informant deposited the amount in the aforesaid Bank and when he went to withdraw the amount, the Manager said that the money would be withdrawn only after 15.03.2017. Thereafter, the bank was found closed. Further allegation is that when informant tried to contact the petitioner, his mobile was found switched off and he absconded.

Patna High Court Cr.Misc. No.7883 of 2018(3) dt.21-03-2018 2/2 Learned counsel for the petitioner has submitted that one of the co-accused has been granted anticipatory bail by this court vide order dated 31.08.2017 passed in Cr. Misc. No. 40020 of 2017.

The case diary has been received, wherein, it has been mentioned that this petitioner was working as Branch Manager in the aforesaid bank. He assured the informant to make payment of the amount on maturity, but did not pay the same and later on absconded.

There is specific allegation against this petitioner who was working as Branch Manager.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.
