1. Heard learned counsel for the parties.
2. The petitioner has renewed his prayer for grant of regular bail in connection with Simri Bakhtiyarpur P.S. Case no. 210 of 2023 registered under section 394 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that the three accused persons on a motorcycle signaled him to stop. By the time he could understand, the accused fired upon him hitting him in his left hand. He was assaulted and his motorcycle was snatched as was Rs.61,278/- which he was
Patna High Court CR. MISC. No.79795 of 2024(2) dt.28-11-2024 2/3 carrying in cash. The accused also took away mobile phone etc. They were aged between 20-25 years.
4. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 24.4.2024 (Annexure-1) passed in Cr. Misc. no. 14844 of 2024. On merits it is submitted that the F.I.R. was registered against unknown. No incriminating article was recovered from the petitioner's possession. The name of the petitioner transpired in the statement of co-accused made before police. Inspite of the petitioner being in custody since 15.9.2023, he has not been put on T.I.Parade and charge-sheet was submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the petitioner having remained in custody for more than a year since 15.9.2023 and charge-sheet having been submitted in the case without putting the petitioner on T.I. Parade, the petitioner is directed to be enlarged on bail in connection with Simri Bakhtiyarpur P.S. Case no. 210 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the
Patna High Court CR. MISC. No.79795 of 2024(2) dt.28-11-2024 3/3 like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa.
