The petitioner seeks bail in a case registered for the offence punishable under Sections 365 and 366 of the Indian Penal Code.

Petitioner and co-accused Manjai Rai are said to have kidnapped the wife and son of the informant. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. There is inordinate and abnormal delay of 18 days in lodging the F.I.R. without assigning any plausible explanation for the said delay. Victim in her statement recorded under Section 164 Cr.P.C. has not named the petitioner in the occurrence of

No.72280 of 2019(2) dt.11-12-2019 2/2 their kidnapping rather has categorically stated that co-accused Manjai Rai had dropped her and her son at Jalandhar on the pretext of taking them to Bombay snatching her mobile. Petitioner has no criminal antecedent and has been languishing in custody since 12.07.2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Madhubani in connection with Basopatti P.S. Case No.156 of 2019. (Prakash Chandra Jaiswal, J) amit/- U T
