This application for regular bail arises out of Warisalignj P.S. Case No. 205 of 2019, disclosing the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
With the allegation of recovery of 40 litres of Mahua country-made liquor, the petitioner and his brothers have been made accused. In addition to the said country-made liquor, certain articles/ utensils have also been recovered, which could be utilised for preparation of country-made liquor. The petitioner is in custody since 08.09.2019. From the statement made in paragraph 3 of the application, it appears that the petitioner has criminal antecedent.
Patna High Court CR. MISC. No.69883 of 2019(2) dt.18-12-2019 2/2 Learned counsel for the petitioner, however, submitted that similarly circumstanced co-accused has been allowed regular bail by this Court by an order dated 06.09.2019, passed in Cr. Misc. No. 61026 of 2019.
Considering the facts and circumstances, as noted above, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ADJ-II cum Special Judge, Nawada in Warisaliganj P.S. Case No. 205 of 2019. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
