Prayer is for grant of anticipatory bail in Nadi P.S. Case No. 13 of 2017 registered under section 380 of the Indian Penal Code.

It is stated that the allegation of having lifted the cash and other articles from the shop is attributed to the full brother of the petitioners. In the F.I.R., only it has been alleged that accused Rohit Kumar has two more brothers i.e. the petitioners. Learned counsel submits that petitioners have no criminal antecedent. Co-accused Rohit Kumar against whom there is specific allegation has also been released on regular bail by the learned Court below.

No.3183 of 2018(2) dt.17-01-2018 2/2 Let the petitioners abovenamed be released on bail in the event of their arrest or surrender in the Court below within four weeks from today on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 5th -cum-Sub-Judge-5, Patna City in Nadi P.S. Case No. 13 of 2017 subject to the condition laid down under section 438(2) of Cr.P.C. with further condition that one of the bailors shall be own/close family member of the petitioners.
