The petitioner is apprehending arrest in a case registered under Sections 363, 366A/34 of the Indian Penal Code. The prosecution case in short is that the accused persons including the petitioner enticed away the minor daughter of the informant for the purpose of marriage.

It has been submitted on behalf of the petitioners that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been recovered. Her statement u/S 164 of the Cr.P.C. was recorded in which she has not made allegation of sexual or physical assault against the petitioner.

On behalf of the State and O.P. No. 2 , it is submitted that the

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupari, Sitamarhi in connection with Pupari P.S. Case No. 13 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
