Petitioner apprehends his arrest in connection with Jhajha P.S.Case No. 164 of 2017 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. Petitioner is husband of deceased and the case is dowry death. Allegation against him is that he killed the deceased and her body was thrown on the railway track.
Submission of learned counsel for the petitioner is that she met with an accident while she was going to attend the call of nature and witnesses have not supported the prosecution case. Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.11263 of 2018 (3) dt.03-04-2018 2/2 petitioner. Petitioner should surrender and pray for regular bail, which shall be considered on the basis of materials available on record.
With the aforesaid observation, this application is dismissed.
