This application is for grant of regular bail in connection with Special Case No.37 of 2017 arising out of F.No.NCB/PZD/V/06/2017for the offences under Sections 8©, 20(b)(ii)(c) and 29 of the N.D.P.S.Act.

There is recovery of huge quantity of Ganja, altogether more than 2903 kg. and the petitioner was arrested at the spot along with the other accused persons. Submission of the learned counsel for the petitioner is that the petitioner has no hands in that and he has been falsely implicated in this case. He is in custody for more than 2 1⁄2 years.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, since the petitioner is not in custody for more than 2 1⁄2 years, rather almost about 33 months, as such the learned Special Judge is directed to conduct the trial on regular basis and try to conclude it within a period of one year.

At the same time, the Sr.S.P., Patna is directed to produce the witnesses before the learned trial court on the date fixed so that the trial may be concluded within the time as stated above.

With the aforesaid observation, this application is dismissed.
