JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-07-2023 At the outset, learned counsel for the petitioners submits that he has made correction in paragraph-3 of the bail petition by filing supplementary affidavit.

2. Heard both sides.

3. Petitioners apprehend their arrest in connection with Khaira P.S. Case No.282 of 2020, registered for the offence punishable under Sections 143, 341, 323, 379, 354(B), 504, 506

Patna High Court CR. MISC. No.10718 of 2023(2) dt.20-07-2023 2/3 and 307 of the Indian Penal Code as well as under Section 27 of the Arms Act.

4. The petitioners are said to have surrounded the house of the informant and made firing and exploded bombs. It is also alleged that the accused persons entered into the house of the informant and looted household articles including jewellery. It is further alleged that the petitioners and other co-accused persons are said to have tried to outrage the modesty of female members of the house of the informant. The accused persons also assaulted some villagers including nephew and brother of the informant.

5. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Petitioner No.1 has got criminal antecedents as stated in paragraph-3 of the bail petition and supplementary affidavit filed by petitioners. It is further submitted that there is general and omnibus allegation against the petitioners. Learned counsel for the petitioners further submits that similarly situated co-accused persons have already been enlarged on bail by a coordinate Bench of this Court vide order dated 12.09.2022, passed in Criminal Miscellaneous No.24798 of 2022 (Annexure-4) as well as by this Court in Criminal

Patna High Court CR. MISC. No.10718 of 2023(2) dt.20-07-2023 3/3 Miscellaneous No.5966 of 2023 dated 10.04.2023 and Criminal Miscellaneous No.7412 of 2023 dated 19.05.2023.

6. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Khaira P.S. Case No.282 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
