JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Bikramganj P.S. Case No. 313 of 2017 dated 16.10.2017 instituted for the offences under Sections 429, 153A, 295(A)/34 of the Indian Penal Code and Section 11(i) of the Prevention of Cruelty to Animals Act, 1960. It has been alleged in the F.I.R that on secret information that huge quantity of cow and buffalo meat are being stored and processed, a raid was conducted for the purposes of preventing any communal clash between the two communities. On seeing the police party, some of the
Patna High Court Cr.Misc. No.15664 of 2018 (2) dt.05-04-2018 2/2 accused persons started running away. Hence, the aforesaid accusation against the petitioners in the subject F.I.R. Learned counsel for the petitioners has submitted that but for the petitioners having been named in the F.I.R, there is no other material to connect them with any offence, if at all such offences are made out from the facts of this case. The petitioners are teachers and farmers and have got no connection with the quantity of cow and buffalo meat which is said to have been recovered. The petitioners do not deal any animal or animal meat.
Considering the nature of accusation and the fact that nothing has been recovered from the personal/constructive possession of the petitioners, let the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 313 of 2017.
