Yadav, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 18-12-2019 Instant petition under Sections 439 and 440 of Criminal Procedure Code has been moved for grant of bail in F.I.R. No. 05 of 2018 dated 07.03.2018 registered at Police Station Kodhobari under Sections 302 and 304(B) of the Indian Penal Code.

I have heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. I have also perused the relevant record of the case, necessary for adjudication of this petition.

At this stage, considering the nature of the offence, the Court is not inclined to grant bail. The trial is in progress and the offence is serious.

At this stage, learned counsel submits that petitioner

Patna High Court CR. MISC. No.70823 of 2019(3) dt.18-12-2019 2/2 shall be content if he is permitted to withdraw the instant petition reserving liberty to file a fresh application after a period of nine months.
