1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 308(4), 119(1), 189(2), 126(2), 115(2), 324(5), 352 and 351(2) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that he purchased one katha land at village Karanpura from Kamlesh Kumar Sharma and thereafter got a seven feet boundary constructed around the land, it is next alleged that thereafter informant appointed Mukesh Singh/Anil Singh for looking after the land, further on 22.05.2025 when the informant came on his land, when Ajeet, Sudhir along with 2-3 unknown
Patna High Court CR. MISC. No.75355 of 2025(2) dt.19-11-2025 2/3 accused came and demanded extortion of Rs. 25 Lakhs or else they will capture his land, but the informant did not take the threat seriously, it is next alleged that on 08.07.2025 he came to know that that the petitioner along with 4-5 co-accused came and demolished the boundary wall on 08.07.2025.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that land of the petitioner is adjacent to the land of the informant and the informant intends to purchase the land, but then petitioner is not willing to sell, as his aunt has filed a Title (Partition) Suit No. 244 of 2018. It is also submitted that allegation of demand of extortion is ornamental.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case
Patna High Court CR. MISC. No.75355 of 2025(2) dt.19-11-2025 3/3 is pending/successor court in connection with Gopalpur P.S. Case No. 277 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
