2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2) and 109 of BNS, 2023 and later on Section 103(1) of BNS 2023 has been added.
3. The informant, namely, Kajal Devi alleged that on 23.12.2024, she got an information that her mother had been assaulted by the petitioner and during course of treatment after seven days of the alleged occurrence, the mother of the informant died.
4. Learned counsel for the petitioner submits that from perusal of the F.I.R. itself, it is apparent that informant is not an eye witness of the alleged occurrence and she has not disclosed the source or name through which she came to know that this petitioner
Patna High Court CR. MISC. No.75870 of 2025(2) dt.14-11-2025 2/2 committed the alleged occurrence. Petitioner is lady with clean antecedent and is in custody since 04.01.2025. Charge-sheet has been submitted.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances and fact that petitioner is a lady, having clean antecedent and is in custody since 04.01.2025, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-X, Begusarai in connection with Sessions Trial No. 557 of 2025 arising out of Birpur P.S.
