The petitioner seeks regular bail in connection with Delha P.S. Case No. 188 of 2023 instituted for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. As per prosecution case, on raids being conducted and different incriminating articles were recovered from the accused persons including the petitioner.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is no recovery from the possession of the petitioner. He next submits that merely on suspicion, petitioner has

He further submits that similarly situated co-accused have already been granted regular bail by different Co-ordinate Benches of this Court passed in Cr. Misc. No. 73878 of 2023 and 75570 of 2023 respectively.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of the case and also the fact that similarly situated co-accused persons have already been granted regular bail by different Benches of this Court, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Gaya in connection with Delha P.S. Case No. 188 of 2023.
