Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode The petitioner seeks regular bail in connection with Purushottampur P.S. Case No. 100 of 2022 lodged under Sections 272 and 273 of the Indian Penal Code and under Section 30(A) of Bihar Prohibition and Excise Act, 2016. As per the F.I.R., total 90 liter of desi wine has been recovered from motorcycle which was kept in two bags and upon chase the petitioner was arrested.
Learned counsel for the petitioner submits that antecedent of the petitioner is clean and he is in custody since
Patna High Court CR. MISC. No.716 of 2023(2) dt.25-03-2023 2/2 11.11.2022. He further submits that petitioner is ready to fulfill all the conditions and assure that he will not involved in such type of activities in future. He further submits that petitioner is not the owner of the vehicle and under a conspiracy, the name of the petitioner has figured in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Bettiah, West Champaran in connection with Purushottampur P.S. Case No. 100 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
With this observation, the bail application stands allowed.
