The petitioners are apprehending his arrest in connection with Harsidhi P.S.Case no.357 of 2017 registered for offences punishable under Sections 341, 447, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioner no.1 is of snatching the Mangalsutra, allegation the petitioner no.2 is that at her instance, her husband assaulted by Farsa, allegation against petitioner no.2 is of causing burn injury by Cholani to one year daughter of the informant.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and there is no specific allegation of assault against the petitioner no.1 and 2. So far petitioner no.3 is concerned, injuries are simple in nature.

Patna High Court Cr.Misc. No.14047 of 2018 (2) dt.10-04-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, so far petitioner no.1 Bindu Devi) and 2 (Naina Devi) are concerned, let the petitioner nos. 1 and 2 surrender before the learned court below and on their surrender, they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Harsidhi P.S.Case No.357 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

So far petitioner no.3 (Chanda Kumari) is concerned, let the petitioner no.3 surrender within a period of four weeks from the date of receipt of the order and make prayer for regular bail which will be considered by the learned trial court on the basis of injuries and the learned court below will dispose of her prayer for bail on the same day.

With the aforesaid observation, this application is disposed of.
