JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with Brahampur P. S. Case No. 348 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code.
The allegation is regarding the co-accused persons having stolen the motor cycle of the informant and the said motor cycle is stated to have been recovered from the coaccused, namely, Vikas Kumar @ Vikar Kumar Rawani. Subsequently, the said Vikas Kumar @ Vikar Kumar Rawani is stated to have been interrogated by the police and is said to have named the petitioner as his accomplice.

No.76134 of 2019(2) dt.25-11-2019 2/2 The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and the said Vikas Kumar @ Vikar Kumar Rawani has already been granted privilege of regular bail by a co-ordinate bench of this court, vide order, dated 06.11.2019, passed in Cr. Misc. No. 68271 of 2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of leaned Chief Judicial Magistrate, Buxar in connection with Brahampur P. S. Case No. 348 of 2019, subject to the conditions as laid down under Section 438(2) of the CrPC.
