JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 This is an application for grant of anticipatory bail in connection with Sarai P. S. Case No. 250 of 2019, disclosing offences under Sections 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. As per F.I.R. there is allegation of recovery of huge quantity of liquor from a Bolero Car standing in front of the house of one Jhinilal Rai, who disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that except the confessional statement, there is nothing against him. He has no criminal antecedent. In this case, case diary was also called for, for verification of the same. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.73345 of 2019(3) dt.09-12-2019 2/2 above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali, at Hajipur, in connection with Sarai P. S. Case No. 250 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
